Partner Terms and Conditions

These terms are a product template and should be reviewed by counsel before public launch.
1. Scope and Definitions
These Partner Terms govern partner onboarding, lounge listing, booking operations, staff access, payments, settlements, content, service quality, and platform use by venue owners, managers, staff, and authorized representatives.
In these terms and elsewhere on the BookGames platform, the word "Partner" refers to the owner or authorized operator of a gaming lounge listed on BookGames — including gaming cafes, esports arenas, console lounges, PC gaming centers, VR arcades, racing simulator lounges, and similar offline recreation venues. Where we mean a payment service provider, marketing collaborator, or other third party, we use the full term such as "payment partner" or "payment gateway partner".
BookGames is a booking and operating platform for offline recreation venues. Partners must use BookGames only for lawful physical venue reservations, station/table usage, session management, and related offline services.
2. Partner Eligibility and Authority
The partner confirms that it is legally permitted to operate the listed venue and that the person onboarding the venue has authority to bind the business.
BookGames may require mobile/email verification, location verification, venue photos, signage proof, business details, ownership or authorization confirmation, tax details, bank verification, payment-gateway KYB, or site verification before making a listing live or enabling settlement.
3. No Prohibited Gaming or Gambling
Partners must not use BookGames for betting, gambling, fantasy gaming, real-money gaming, lottery, cash contests, games of chance involving money or prizes, wallet withdrawals, money transfer schemes, illegal tournaments, or any service prohibited by law, payment partner rules, or BookGames policy.
Partners must ensure that venue services booked through BookGames are limited to offline recreational use of physical venue slots, tables, consoles, PCs, VR stations, racing simulators, board games, or similar resources.
BookGames may suspend listings, withhold settlement, cancel bookings, or report activity if a partner is suspected of prohibited use.
4. Onboarding and Listing Information
Partners must provide accurate and current listing details including venue name, address, map pin, contact details, operating hours, station/resource inventory, pricing, photos, amenities, policies, staff roles, and availability.
Partners must not misrepresent venue quality, capacity, device availability, pricing, discounts, service inclusions, location, affiliation, safety, or brand authorization.
BookGames may review, approve, reject, edit, moderate, or remove listing content to maintain marketplace quality, legal compliance, payment partner compliance, and customer trust.
5. Operations and Booking Fulfilment
Partners must honor confirmed bookings, keep resource availability accurate, maintain devices and premises in safe working condition, and provide the booked service at the confirmed time and price.
Partners must promptly mark check-in, no-show, cancellation, extension, maintenance, and resource unavailability events in the platform.
Partners are responsible for on-site staff behavior, customer safety, venue cleanliness, equipment condition, local permits, age restrictions if any, and compliance with applicable laws.
6. Pricing, Fees, and Taxes
Partners must keep pricing accurate and disclose applicable inclusions/exclusions. BookGames may support base price, platform fee, convenience fee, gateway fee, GST, discounts, cancellation fee, no-show fee, extension fee, or other disclosed charges.
Unless agreed otherwise in writing, partners are responsible for their own taxes, GST registration if applicable, invoicing obligations, accounting records, and reporting of revenue received from bookings.
BookGames may charge platform fees, subscription fees, commissions, advertising fees, payment processing charges, or other fees as agreed in commercial terms or shown in the dashboard.
7. Payments and Settlement
Online payments may be processed through payment aggregators, banks, UPI providers, card networks, or other payment partners. Settlement activation may require payment partner KYC/KYB, bank verification, beneficiary creation, risk review, and approval.
BookGames should store only the settlement identifiers, masked bank details, verification status, and operational metadata needed to manage payouts where the payment partner can host full KYB.
Partners agree that payment partners may collect and verify bank, tax, identity, and business information for settlement and compliance.
Settlements may be delayed, withheld, reversed, adjusted, or blocked due to refund claims, chargebacks, suspected fraud, risk review, payment partner holds, compliance review, bank failures, incorrect bank details, or legal/regulatory requirements.
Partners must not request customers to bypass BookGames payment flows for confirmed online bookings unless BookGames explicitly supports pay-at-venue or offline payment for that booking type.
8. Cancellations, Refunds, and No-Shows
Cancellation and refund policies are configured and enforced through BookGames policy controls. Partners must not create conflicting refund promises outside the platform for BookGames bookings.
If a partner cancels a booking, fails to honor availability, provides a materially different service, or causes a service failure, BookGames may refund the player and recover the amount from partner settlement or future payouts.
No-show handling, grace periods, cancellation fees, deposit forfeiture, and refund percentages must follow the policy shown in the platform.
9. Staff Access
Partners are responsible for inviting, assigning, supervising, and removing staff access. Staff accounts must be used only by the assigned person. Partners must promptly revoke access when staff leave or change roles.
Actions by staff in the partner dashboard may be treated as partner-authorized actions. BookGames may audit staff activity for fraud, abuse, safety, support, or compliance reasons.
10. Customer Data and Privacy
Partners may access customer data only to fulfil bookings, provide support, resolve disputes, ensure safety, and comply with law. Partners must not sell, misuse, scrape, export, or contact customers for unrelated marketing unless permitted by law and consent.
Partners must protect customer data, booking records, access codes, chats, phone numbers, emails, and payment-related information from unauthorized access or disclosure.
Partners must not ask customers for card numbers, CVV, UPI PIN, OTP, netbanking passwords, or other payment credentials.
11. Content, Photos, Reviews, and Brand Use
Partners grant BookGames a non-exclusive, worldwide, royalty-free license to host, display, reproduce, moderate, and use venue names, logos, photos, descriptions, pricing, availability, and other listing content for platform operation and promotion.
Partners must own or have rights to listing content. Partners must not upload misleading, infringing, obscene, unsafe, or unlawful content.
Partners must not post fake reviews, incentivize false reviews, pressure players to remove honest reviews, or impersonate customers.
12. Compliance, Suspension, and Liability
BookGames may suspend, restrict, delist, or terminate a partner account or lounge listing for poor service quality, repeated cancellations, high complaint rates, fraud signals, prohibited activity, payment disputes, policy violations, legal risk, or payment partner requirements.
Partners agree to indemnify BookGames against claims, losses, penalties, chargebacks, refunds, damages, and expenses arising from partner services, listing inaccuracies, tax non-compliance, staff conduct, venue safety issues, prohibited activity, IP infringement, customer disputes, or breach of these terms.
To the maximum extent permitted by law, BookGames is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages.
13. Support, Changes, Law, and Disputes
Partners must maintain responsive support for venue-level booking issues. BookGames may operate central support for booking, payment, refund, platform, and compliance issues.

BookGames may update these Partner Terms. These terms are governed by the laws of India. Final dispute venue, arbitration clause, and jurisdiction should be confirmed by legal counsel before launch.
